Welcome to SoftPaperTrail ("we," "us," or "our"). The following Terms & Conditions ("Terms") apply to your use of our yacht rental services and the website hosted at softpapertrail.rest (referred to as "Service"), managed by SoftPaperTrail.
By reserving a yacht or utilizing our Service, you consent to these Terms. If you do not agree with any part of the terms here, you are not permitted to use the Service.
2. Service Overview
SoftPaperTrail offers luxury yacht rental services, which include a variety of options such as:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All offerings are subject to change based on availability and weather conditions. We may adjust or discontinue any service without prior notice.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you must:
- Confirm you are at least 18 years old
- Provide valid and complete details
- Make a deposit payment as indicated in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed upon our receipt of your payment and the issuance of our confirmation in writing. We reserve the right to deny service at our discretion.
3.3 Availability
Charter services depend on the availability of vessels and favorable weather conditions. We will strive to meet your requested dates and times wherever possible.
4. Payment Terms
4.1 Pricing
All price quotes are in € and include any applicable taxes unless stated otherwise. Prices may change without any prior announcement.
4.2 Payment Schedule
- Deposit: Required amount being 50% of the charter cost at the time of reservation
- Balance: To be cleared 48 hours prior to the departure of the charter
- Additional fees (if applicable): Payable at the end of the charter
4.3 Payment Methods
We accept various forms of payment including major credit cards, wire transfers, and bank-certified checks. All payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund, minus processing fees
- If canceled within 24 to 72 hours of departure: 50% refund
- If canceled less than 24 hours before departure: No refund is provided
5.2 Weather Cancellations
In case the captain considers the weather unsafe, we will propose to:
- Reschedule the charter to a new date at no extra cost
- Issue a full refund if rescheduling is not possible
5.3 Mechanical Issues
If there is a mechanical failure with the assigned yacht, we will endeavor to arrange an appropriate replacement. If we cannot provide a suitable alternative, a full reimbursement will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Obey all instructions from the crew
- Wear safety equipment as needed
- Disclose any medical conditions that could affect their safety
- Stay in designated areas onboard
6.2 Prohibited Items
Passengers are not allowed to bring the following on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive non-alcoholic beverages beyond reasonable personal consumption
- Pets, except if permission was given beforehand
6.3 Conduct
Passengers should behave respectfully. If passenger actions pose a safety threat or cause disruption to the experience of others, we can end the charter early without a refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the charter fee you have paid. We are not liable for:
- Injuries that occur due to the passenger's own negligence
- Damage or loss of personal belongings
- Indirect damages like consequential or punitive losses
- Delays due to weather or events outside our control
7.2 Insurance Coverage
We maintain extensive marine insurance for our vessels and operations. Passengers are recommended to have their travel and personal insurance policies in place.
7.3 Assumption of Risk
By partaking in our yacht services, you recognize the natural risks of maritime activities and accept personal responsibility for your safety and health.
8. Modifications and Itinerary Changes
We keep the right to alter itineraries, paths, or timetables due to factors such as weather, safety concerns, or operational necessities. We will attempt to offer a comparable alternative should changes occur.
9. Force Majeure
We hold no responsibility for disruptions, delays, or alterations resulting from unforeseeable forces beyond our control, which can include:
- Extreme weather events
- Natural calamities
- Governmental rulings
- Port shutdowns
- Marine equipment failure
10. Privacy and Data Protection
We manage your personal data according to our Privacy Policy. Utilizing our services implies consent to our data collection and usage as specified in the Privacy Policy.
11. Intellectual Property
Our website's content, including texts, images, logos, and other visual media, is protected by copyright and trademark laws. You must not use, duplicate, or adapt our content without our express written consent.
12. Governing Law
The enforcement of these Terms will be governed by the laws in force within France. Any dispute will be resolved within the jurisdiction of the courts in Cannes, France.
13. Changes to Terms
We reserve the right to update these Terms as necessary. Any amendments will be communicated on our website along with the respective revision date. Continued usage of our services means accepting the revised terms.
